Terms of Service

最后更新:1 OCTOBER 2026

These are the rules for using CrowdOS. Please read them: by creating an account, paying or using the Service you agree to them, to the Acceptable Use Policy, the Refund and Payment Policy and the Privacy Policy.

1. Agreement

These Terms of Service (the "Terms") are a binding agreement between you (the "Customer", "you") and Motif Motion Pte. Ltd., trading as CrowdOS ("we", "us"). They apply to the CrowdOS website, applications, programming interfaces (the "API") and everything we provide through them (together, the "Service"). They take effect on 1 October 2026.

You accept these Terms electronically. You agree to them when you create an account, tick or click to accept, make a payment, use the Service or the API, or continue to use the Service after we have notified you of an updated version. If you do not agree, do not use the Service.

These Terms incorporate the Acceptable Use Policy, the Refund and Payment Policy, the Privacy Policy and the Cookie Policy. Our electronic records of your acceptance, including the date and time, your IP address and the version accepted, are admissible and, absent manifest error, conclusive evidence that you accepted these Terms.

2. Who may use the Service

The Service is intended for business and professional use by people aged 18 or over. It is not offered for personal, family or household use, to the extent it is lawful for us to say so. If you use the Service on behalf of an organization, you confirm that you have authority to bind that organization to these Terms, and "you" includes that organization.

3. The Service and its nature

The Service lets you put questions, materials and scenarios to AI-generated synthetic respondents and receive their simulated answers and analysis ("Results"). Synthetic respondents are not real people. Results are estimates produced by software.

  • Results are not a substitute for research with real people, and are not suitable where the law or a regulator requires human-subject research or real consumer or voter consultation.
  • Results are not professional, legal, medical, financial or investment advice. You are responsible for how you use them and for any decision you make.
  • We do not guarantee that any Result is accurate, complete, current, representative or fit for your purpose. Any figures we publish about the Service are historical, relate to specific question sets and conditions, and are not a promise of future performance.
  • Similar inputs may produce different Results at different times.

You are solely responsible for deciding whether the Service is appropriate for your purposes, for reviewing Results before relying on or publishing them, and for any claim made to your own customers, clients, regulators or the public that is based on them. If you publish or share Results, you must not describe them as the opinions of real people or as the findings of a survey of real people, and you should make clear that they are AI-generated estimates. We may improve, change or retire features, question formats and output types at any time.

4. Accounts and security

You must give accurate information and keep it up to date. You are responsible for keeping your password, sign-in methods and API keys confidential, and for all activity under your account and keys. Do not share credentials. Tell us promptly at hello@motifmotion.sg if you suspect unauthorised use. We may act on instructions given through your account or keys as yours.

If you use the API, you must keep within the rate limits and quotas that apply to your plan, and you must not build the API into a product in a way that exposes our credentials or lets your own users bypass these Terms. You are responsible for the acts and omissions of everyone you allow to use your account, your keys or your integration, including your employees, contractors and end users. You are responsible for obtaining any consent or notice that the law requires in order for you to submit Your Content to us.

5. Plans, credit and payment

The Service is paid for from a prepaid wallet ("Credit") at per-respondent prices shown in the product at the time you launch a study. You may add Credit by paying through our payment processor. We also offer Pro and Max monthly subscriptions, billed through our payment processor. Details of refunds and payment handling are in the Refund and Payment Policy.

The monthly wallet credit is included only with a paid subscription, and is granted only after the subscription payment has been received. A plan or access tier granted or comped by us without payment carries that tier's limits and features but no monthly credit and no cash value.

  • Credit is personal to your account, is non-transferable, has no cash value, earns no interest and may be forfeited if we terminate your account for breach.
  • Organizations on invoiced terms pay by invoice within the period stated on the invoice, or 30 days from the invoice date if none is stated. We may suspend the Service for amounts that are overdue.
  • We may change prices and plans prospectively. A change does not affect a study already launched.
  • Prices exclude taxes, duties and bank or currency-conversion charges, which you are responsible for. If we are required to collect tax, we will add it to the amount payable.
  • Subscriptions renew automatically each month until cancelled. You may cancel at any time, and cancellation takes effect at the end of the period you have paid for.
  • We may refuse or cancel any order, and may correct pricing errors, before a study is delivered.
  • If you dispute a payment or initiate a chargeback, we may suspend your account, reverse any Credit granted for the disputed payment (including by taking your balance below zero until repaid) and recover our reasonable costs. Please contact us first at hello@motifmotion.sg so we can resolve the issue; we may give your acceptance records and usage logs to your bank, the card network and our payment processor as evidence.

6. Acceptable use

In summary, you must not use the Service unlawfully, deceptively or in a way that harms others, and you must not try to copy, extract, probe or reproduce how the Service works. You must not use the Service or its outputs to build or improve a competing product, or to train or evaluate another AI model. We may monitor use for security and compliance and may limit or block activity that appears automated or abnormal.

You must use the Service in accordance with the Acceptable Use Policy, which forms part of these Terms. A breach of that policy is a breach of these Terms.

7. Your content and the Results

You keep ownership of the questions, materials and other content you submit ("Your Content") and, as between you and us, you own the Results generated for you. You may use Results commercially, subject to these Terms and to clause 3 (they are not research with real people, and you must not present them as such).

You grant us a worldwide, non-exclusive licence to host, process, copy and use Your Content and Results as needed to operate, secure, support and improve the Service and to comply with law, in accordance with our Privacy Policy. We do not sell personal data and we do not disclose Your Content to other customers. You confirm you have the rights needed to submit Your Content and to grant this licence.

We may also use data about how the Service is used, in aggregated or de-identified form that does not identify you, to operate, secure, analyse and improve the Service. You are responsible for the legality, accuracy and appropriateness of Your Content. We are not obliged to keep Your Content or Results for any particular period, and we may delete them after your account is closed or if we reasonably consider that retention is unlawful or a risk. We may remove or refuse to process Your Content that we reasonably believe breaches these Terms or the law.

8. Our intellectual property and confidentiality

We and our licensors own the Service and everything in it, including its methods, models, prompts, configurations, designs, software, performance data and know-how. You receive only a limited, revocable, non-exclusive, non-transferable right to use the Service during these Terms for your internal business purposes.

Non-public information about how the Service works is our confidential information. You must not disclose it, reverse engineer or extract it, or use the Service or its outputs to build a competing or substitute product or to train, fine-tune or evaluate any other AI model.

If you give us feedback or suggestions, you grant us a perpetual, irrevocable, royalty-free licence to use them without obligation to you.

9. Service availability; no service levels

The Service is provided "as is" and "as available". We do not promise that it will be uninterrupted, timely, secure or error-free. Outages, maintenance, degraded performance, delays, errors, incomplete or failed studies and loss of data can occur, and we are not liable for them. We may suspend or restrict the Service at any time for maintenance, upgrades, security or capacity reasons, with or without notice. The Service depends on third parties, the internet and events beyond our control. Where a study fails, the credit described in the Refund and Payment Policy is your sole remedy. We offer no service levels unless we agree them with you in writing.

10. Security incidents

No system is fully secure. We take reasonable measures to protect the Service, but we do not warrant that the Service or any data will be free from unauthorised access, hacking, malware, denial-of-service or other attack. To the fullest extent permitted by law, we are not liable for losses arising from such attacks or breaches, except where they are caused by our wilful default or where the law does not permit the exclusion. You are responsible for keeping your own backups of Results and for the security of your account. We will give notice of a data breach where the law requires it.

11. Disclaimer of warranties

TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICE AND ALL RESULTS ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING ANY WARRANTY OF MERCHANTABILITY, SATISFACTORY QUALITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, NON-INFRINGEMENT, OR UNINTERRUPTED OR ERROR-FREE OPERATION. NO ADVICE OR INFORMATION GIVEN BY US OR THROUGH THE SERVICE CREATES ANY WARRANTY NOT EXPRESSLY STATED IN THESE TERMS.

12. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE LOSS, OR FOR ANY LOSS OF PROFITS, REVENUE, BUSINESS, DATA OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH THE SERVICE OR THESE TERMS, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE) OR OTHERWISE, EVEN IF WE WERE ADVISED OF THE POSSIBILITY OF SUCH LOSS.

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR IN CONNECTION WITH THE SERVICE OR THESE TERMS WILL NOT EXCEED THE AMOUNTS YOU PAID US IN THE THREE (3) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR S$100 IF YOU PAID NOTHING.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence, or for fraud.

13. Indemnity

If we ask, you will cooperate with us in the defence of any claim and you may not settle a claim in a way that imposes obligations on us without our written consent. You will defend and indemnify us, our affiliates, officers, employees and contractors against all claims, losses, liabilities, damages and costs (including reasonable legal fees) arising out of or related to Your Content, your use of the Service or Results, your breach of these Terms or the Acceptable Use Policy, or your violation of any law or third-party right.

14. Force majeure

We are not liable for any failure or delay caused by events beyond our reasonable control, including acts of God, fire, flood, war, terrorism, civil unrest, pandemic or epidemic, government action, power, internet, telecommunications or cloud failure, failure of any third-party provider, cyberattack, and labour disputes.

15. Suspension and termination

We may suspend or terminate your access immediately, with or without notice, if you breach these Terms, if we reasonably believe your use poses a risk to us, the Service or others, if you fail to pay, or where the law requires. You may close your account at any time from your account settings or by contacting us. Suspension does not relieve you of any payment obligation, and we may, but are not required to, restore access once the reason for suspension has been resolved to our reasonable satisfaction.

On closure or termination your right to use the Service ends. Unused Credit is dealt with as set out in the Refund and Payment Policy and may be forfeited if we terminate for your breach. Clauses that by their nature should survive (including clauses 3, 5, 8 and 10 to 20) survive termination.

16. Changes to the Service and these Terms

We are always developing the Service. Features, limits, plans, question formats, audience options and output formats may change, and we may add or remove them at any time. We will try to give reasonable notice of a change that materially reduces the paid features you are using, but we are not obliged to continue offering any feature.

We may change or discontinue any part of the Service. We may update these Terms from time to time by posting the new version on our website and, for existing users, by asking you to accept it the next time you sign in. Your continued use of the Service, or any payment, after notice of an update is your acceptance of it. If you do not agree to an update, you must stop using the Service.

17. Governing law and disputes

These Terms and any dispute or claim (whether in contract, tort, statute or otherwise) arising out of or in connection with them, their breach, validity or termination, or the Service, are governed by the laws of Singapore, without regard to conflict-of-laws rules.

  • Notice and negotiation. A party with a dispute must first give the other written notice describing it, and the parties will try in good faith to resolve it within 30 days of that notice.
  • Arbitration. A dispute not resolved in that time will be finally resolved by binding arbitration under the Arbitration Rules of the Singapore International Arbitration Centre (SIAC) in force at the time. The seat is Singapore, there will be one arbitrator, and the language is English.
  • Individual claims only. To the extent permitted by law, claims may be brought only on an individual basis, and not as a class, collective or representative action.
  • Courts. Either party may seek urgent injunctive relief from the courts of Singapore, which have exclusive jurisdiction in aid of arbitration and over any matter that cannot be arbitrated.
  • Time limit. To the extent permitted by law, any claim must be commenced within one (1) year after it arose, or it is barred.
  • Costs. Each party bears its own costs, except as the tribunal awards.

18. General

  • Interpretation. Headings are for convenience only. "Including" means "including without limitation". References to a policy are to its current version on our website.
  • Electronic records. You agree that our electronic records, including logs and acceptance records, are valid evidence of the matters they record, and you waive any objection to their admissibility because they are in electronic form.
  • Entire agreement. These Terms, with the policies they incorporate, are the entire agreement between us about the Service and replace earlier understandings.
  • Severability and waiver. If a provision is unenforceable, the rest continues and the provision is applied to the extent it can be. A failure to enforce a right is not a waiver of it.
  • Assignment. We may assign these Terms. You may not assign or transfer them without our written consent.
  • Notices. We may give notice by email to your account address or by posting on our website or in the Service. You may give notice to us at hello@motifmotion.sg.
  • Third parties. A person who is not a party to these Terms has no right under the Contracts (Rights of Third Parties) Act 2001 of Singapore to enforce any of them.
  • Language. The English text governs any translation of these Terms.

19. Relationship of the parties

We are independent contractors. Nothing in these Terms creates a partnership, agency, joint venture or employment relationship between us.

The Service may link to or work with products and services that we do not control. We are not responsible for them, and your use of them is subject to their own terms. You must comply with all laws that apply to your use of the Service, including laws on advertising, consumer protection, data protection, export controls and sanctions. Unless we agree otherwise in writing, we may identify you as a customer by name and logo in a customer list, and you may ask us to stop at any time.

20. Contact
